1. Definitions
1.1 Below is a list of “Terms” of expression together with their definitions used on the website and in other materials:
“Maths Momentum” refers to the name of the company that liaises with Students and Clients to provide a requested service.
“Us”, “We” or “Our” means Maths Momentum.
“Client” refers to the parent(s), guardian(s) and educational institution(s) who have registered with us for our services.
“Student” refers to person(s) requiring/receiving tuition services by a tutor.
“Parent(s)” refers to the parent(s), guardian(s) or educational institution(s) acting on behalf of the student to request tuition services by a tutor.
“Tutor” refers to a person suitably qualified and experienced to provide tuition services.
“You” can refer to Tutors, Clients, Students and guests who use our website or contact us.
1.2 Tutors, Clients and Students are subject to these Terms for all business undertaken by Maths Momentum, unless otherwise agreed in writing by Us.
2. Website Terms of Use
2.1 By using this Website, you agree to be bound by these Terms together with our Privacy Policy (which explains how we process personal data we collect from you) & Cookie Policy (which explains the definition of cookies and how we use them).
2.2 Your use of this Website means that a contract consisting of these Terms is formed between Us and You which governs Your use of this Website and Your access to the services available on this Website from time to time.
2.3 These Terms will apply:
Howsoever you decide to access the Website (including via a desktop browser, any mobile device application or tablet).
To all users of the Website, including Tutors, Clients, Students and guests.
2.4 If you do not agree to these Terms, you must cease using the Website.
2.5 Every time you access the Website, the Terms in force at that time will apply to your use of the Website.
3. Indemnity
3.1 The Client shall indemnify and keep indemnified Maths Momentum against any costs, claims and/or liabilities incurred by Maths Momentum arising from any assignment or due to any breach of these Terms by the Client.
3.2 Maths Momentum does not accept any liability for the consequences of tuition, including, but not limited to, exam results and coursework scores.
4. Responsibilities
4.1 Tutor responsibilities:
Prepare and deliver engaging and productive lessons.
Provide exercises and homework upon request.
Assess learning and provide constructive feedback throughout each lesson.
4.2 Student responsibilities
Ensure You have access to a working internet connection and computer microphone for each lesson.
Take lesson notes as appropriate.
Complete assigned homework within the deadline.
Communicate effectively with the Tutor to maximise learning.
4.3 Client Responsibilities
Promptly inform Us of any changes to contact details.
Encourage the Student to complete any homework and assignments as appropriate.
Settle invoices within 7 days of their receipt.
5. Payment
5.1 The hourly fee is inclusive of preparation time, but not inclusive of any requested marking.
5.2 All charges in addition to the hourly fee rate (in the event that any are incurred) will only be invoiced after they have been approved by the Client.
5.3 Invoices will be sent on last calendar day of each month.
5.4 The Client shall settle all invoices within 7 days of their receipt.
5.5 Acceptable forms of payment include:
Cash
Bank Transfer
Paypal
5.6 The Client is liable for all transfer fees incurred (such as international transfer fees).
5.7 Due to ethical reasons, no interest will be charged for late payments.
5.8 All services will be suspended if the Client fails to settle an invoice within 14 days, and may resume once the invoice is settled.
6. Lesson Arrangements
6.1 Lessons will be scheduled on an ad hoc basis, as agreed by all parties, with the exception of block-booked lessons.
6.2 The Client's agreement upon a date is implicit of the Student's agreement, and vice versa.
6.3 Conference call platforms for tuition include:
Skype
Zoom/Zhumu
Google Hangouts/Meet
7. Discounts & Promotions
7.1 All discounts and promotions may be used in conjunction with Group Tuition discounts (group discount will be applied after the initial discount.)
7.2 Discounts cannot be used in conjunction with one another.
7.3 Discounts cannot be used in conjunction with a promotional offer.
7.4 Promotional codes may be used for only 1 hour per student.
7.5 Block-booking discounts:
Minimum lesson duration is 60 minutes.
Cancellations are non-refundable.
Regular rescheduling policies apply
8. Cancellations & Rescheduling
8.1 The Client or Student must provide at least 48 hours' notice via email or phone for all cancellations or rescheduled lessons.
8.2 Our cancellation fees are as follows:
Unforeseen emergencies incur a 0% Charge.
The 1st incident within a calendar month incurs a 50% Charge.
The 2nd incident and upwards within a calendar month incurs a 100% Charge.
These fees are waived if a replacement lesson occurs within 7 days of the original lesson date.
8.3 Unforeseen emergencies, without sufficient notice, upwards of 2 incidents per calendar month must be substantiated with a suitable form of evidence. Otherwise they will not be treated as unforeseen emergencies.
9. Faulty Equipment
9.1 If the Tutor's hardware or software is faulty to the extent that the lesson cannot practically take place, the Client will incur a 0% charge and be given the option to reschedule free of charge.
9.2 If the Student's equipment is faulty (such as a poor internet connection), within a calendar month:
The first incident will incur a 0% charge.
The second incident will incur a 50% charge for the pre-agreed lesson time.
The third incident and upwards will incur a 100% charge for the pre-agreed lesson time.
